My Day Glass™ — Beta Terms

MY DAY GLASS (TM) BETA SOFTWARE LICENSE & TERMS OF USE

PLEASE READ CAREFULLY. BY INSTALLING, ACCESSING, OR USING MY DAY
GLASS (THE "SOFTWARE"), INCLUDING THE WEBSITE AT MYDAYGLASS.COM,
THE DESKTOP APPLICATION, AND THE ANDROID APPLICATION, YOU AGREE
TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SOFTWARE.

1. BETA STATUS. The Software is pre-release BETA software provided
for evaluation. Features may change, malfunction, or be removed at
any time without notice. Availability is not guaranteed.

2. LICENSE. BG Latitude LLC grants you a personal, limited,
non-exclusive, non-transferable, revocable license to use the
Software for personal purposes. The Software is licensed, not sold.
You may not copy, modify, distribute, sell, reverse engineer,
decompile, or create derivative works from the Software except as
permitted by law.

3. NO WARRANTY. THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE"
WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT
LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, AND NON-INFRINGEMENT.

4. DATA & BETA RISK. You acknowledge that beta software may lose,
corrupt, or fail to save data, including schedules, goals, and
account information. Maintain your own copies of anything important.
Guest data is stored only on your device and may be lost at any time.

5. ACCOUNTS & PRIVACY. If you create an account, we store your
email, optional username, an encrypted password if you set one, and
your saved planning data, in order to operate the service. We log
visits (including IP address and browser information) to operate and
protect the service. Emails submitted at the entrance may be used to
contact you about My Day Glass. We do not sell your personal
information. You may request deletion of your account data by
contacting BG Latitude LLC.

6. LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW,
BG LATITUDE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL,
SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST DATA,
LOST PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM USE OF THE
SOFTWARE. TOTAL LIABILITY SHALL NOT EXCEED FIFTY DOLLARS (USD $50)
OR THE AMOUNT YOU PAID FOR THE SOFTWARE, WHICHEVER IS GREATER.

7. TERMINATION. This license ends automatically if you breach these
terms. BG Latitude LLC may suspend or discontinue the beta, or any
account, at any time.

8. INTELLECTUAL PROPERTY. My Day Glass(TM), the MDG mark, and all
software, designs, and content are the property of BG Latitude LLC.
All rights reserved.

9. GOVERNING LAW. These terms are governed by the laws of the State
of New York, USA, without regard to conflicts of law. Venue lies in
the state and federal courts located in Kings County, New York.

10. CHANGES. We may update these terms; continued use after an
update constitutes acceptance.
